ORDINANCE NO 2008-01

AN ORDINANCE ESTABLISHING CAMINO LOMITA AS A
VILLAGE STREET/PUBLIC RIGHT OF WAY
WHEREAS, Camino Lomita, has been treated as a public roadway within the Village of Pecos, New Mexico for many decades; and

WHEREAS, the Village finds no evidence of the official establishment of Camino Lomita as a Village street; and

WHEREAS, Section 3-49-1 NMSA 1978 allows a municipality to establish streets and thereafter to regulate their use and provide for their maintenance.

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES, THE GOVERNING BODY OF THE VILLAGE OF PECOS, NEW MEXICO, that:

1. Finding.

Camino Lomita is found to be a two lane public street/right-of-way commencing at State Road 63 and continuing to the St. Anthony Cemetery, which the Village of Pecos, New Mexico may regulate in order to protect the roadway, its infrastructure and utilities and for the benefit of the citizens of the Village of Pecos.

2. Establishment of Camino Lomita as a Village Street/public right of way.

Camino Lomita, which is more particularly described as shown on Exhibit A attached hereto [to the Ordinance] which Exhibit is incorporated herein by reference, be and it is hereby established as a Village Street/public right of way of the Village of Pecos, New Mexico.

Contractors having established an account with the P. S. & E. Section prior to the publishing of the Invitation For Bids may charge the deposits to their accounts. Other contractors may obtain the bidding documents by paying in advance the required deposit to the P. S. & E. Section. Such deposits shall only be made by check or money order payable to the New Mexico Department of Transportation. Deposits may be credited to the contractor's account or refunded by the Department, as appropriate, provided the contract bidding documents are returned prior to bid opening in usable condition by the contractor who obtained them. Usable condition shall mean that the contract book and plans have been returned to the P. S. & E. Section in complete sets, have not been marked, defaced, or disassembled, and no pages have been removed.

As an option, the Department has implemented the Bid Express website www.bidx.com)">(www.bidx.com) as an official depository for electronic bid submittal. Electronic bids submitted through Bid Express do not have to be accompanied by paper bids. CASE 14255: This case concerns the proposed amendment of 19.15.39 NMAC to add two new sections setting out special provisions for Santa Fe County and the Galisteo Basin, which extends into portions of San Miguel and Sandoval Counties. Proposed section 19.15.39.9 NMAC requires operators to obtain the approval of the Oil Conservation Division (Division) for an exploration and development plan prior to drilling, re-entering or deepening a well in Santa Fe County or the Galisteo Basin, and requires the operator to renew the plan every five years. The operator will be required to operate the wells covered by the plan in accordance with the plan's requirements until the plan is specifically replaced by a special pool order. The proposed rule sets out the process for obtaining, amending, renewing and replacing exploration and development plans. Proposed section 19.15.39.10 NMAC sets out conditions that will be applied to applications for permits to drill, re-enter or deepen a well covered by an exploration and development plan. These conditions will apply unless the operator's approved exploration and development plan recognizes an exception.

Any person recommending modifications to a proposed rule change shall, no later than Monday, November 24, 2008, file a notice of recommended modifications with Ms. Davidson including the text of the recommended modifications, an explanation of the modifications' impact, and the reasons for adopting the modifications. Written comments on the proposed amendment and pre-hearing statements must be received no later than 5:00 p.m. on Wednesday, December 3, 2008. Any person may present non-technical testimony or make an un-sworn statement at the hearing. Any person who intends to present technical testimony or cross-examine witnesses at the hearing shall, no later than 5:00 p.m. on Wednesday, December 3, 2008, file six sets of a pre-hearing statement with Ms. Davidson.
